Holiday DUI is Down
The CHP (California Highway Patrol) says that there were only 75 drunken driving arrests in the county so far this Thanksgiving holiday weekend. This is an improvement from last year, CHP officers made 92 DUI arrests in the county. The only fatalities reported countywide this weekend occurred in Balboa Park at midnight, when a driver and passenger were killed in a rollover crash. Statewide, CHP officers made 942 DUI arrests between Wednesday evening and Saturday morning. Last year, 618 arrests were made in all, Cross said. In the Bay Area's nine counties, the CHP made 82 arrests in the four-day period last year. This year, there were 83 arrests through Friday morning.



Woman Arrested For DUI and
A passenger was killed when the car in which she was riding hit a tree in the center median on North McDowell Boulevard Friday night. The female Petaluma woman was subsequently arrested on charges of vehicular manslaughter and for felony DUI drunken driving. The passenger was dead when officers and paramedics arrived. The DUI woman only suffered a minor injury to her finger and was transported to Petaluma Valley Hospital. The collision is under investigation and police are looking for witnesses.

Judge Shameem On Criminal Law

Justice Nazhat Shameem believes that those that are vulnerable, children, women and the disabled - are not getting the equality before the law. Ignoring the social inequalities in effecting justice would render the justice system an unequal one. She said the rule of law was completely pointless because a large sector of the population could not gain access to the criminal justice system without a lawyer or without "the confidence that comes with education". In calling for reform through legislation, High Court judge Justice Nazhat Shameem said any reform over that period was either sporadic or piecemeal. In Fiji, much of the law is outdated, still following its archaic terms, not with modern advances yet. Fiji larceny offices in the Penal Code are still outdated and not relevant, gislative provisions have not caught up with common law and human rights developments on the law.



She was speaking at the 10th anniversary of the Attorney-Gerneral's conference at Shangri-La Fijian Resort where 150 delegates have gathered for a two-day meeting.



Judge Shameem stressed the need for both video or audio tape of the police confessions, this will prevent the suspect from false allegations of assault and unfairness. Shameem also believes that this will see a rise in a number of guilty pleas. She said the courts spend a great deal of time of the criminal trial determining the admissibility of confessions made to the police as there are allegations of assault, inducements, oppressive hours of questions, unfairness and a failure to explain constitutional rights.



She said The Community Work Act 1994 and the Rehabilitation of Offenders Act were notable exceptions, the commission only implemented what was politically willed.



"If there is no will there is no reform," she said adding reform could come from two sources - judicial decisions or through arrangements between criminal justice agencies.



"There is much in the criminal justice system to reform. Antiquated criminal laws, outdated laws of procedures and evidence, a lack of transparency in judicial and police procedures are only some of them. Reform can be effected in most cases by a will to reform."



At the Transparency International workshop on access to justice in Lautoka this week, the Fiji judge is also saying that shopping has become a serious problem for the judiciary in modern Fiji. Justice Nazhat Shameem said that the legal profession is quiet on the subject of judge shopping - an unfair process by which lawyers try to pick a particular judge to hear their cases. Appointing judges and magistrates on merit can be a mechanism to prevent such judicial corruption.

Guilty Verdict in Myspace Cyberbullying Case

A Missouri woman that was cyber-bullying a depressed teenage girl, Megan Meier, has been convicted by a federal jury in Los Angeles on three misdemeanor counts of computer fraud. The bad news is that she is not guilty of more serious charges.



Her hoax ultimately led to the young gir's suicide. Megan Meier suffered from depression eventually committed suicide after corresponding with Drew. In one of Drew's message she wrote "The world would be a better place without you."The woman Lori Drew was convicted of three misdemeanors for violating MySpace's "terms of service," which requires users to submit "truthful and accurate" registration information.



Do not be underestimate this cyber-bullying verdict though. There is a valauable significance in this Los Angeles federal court case, it expands the federal Computer Fraud and Abuse Act, which was passed in 1986 as a tool against hackers, to include social networking Web sites. This verdict should really send an overwhelming message to internet users, especially those who abuse social networking websites.



Some still argue that the governmen is misusing the law. People with the tech industry fear about an expansion of the fraud act. One can argue that users have perfectly good reasons to construct false identities online, such as preventing identity theft of personal information.



The New York Times raised the idea that we will look back on this case as the inflection point at which the Internet changed from free and anonymous to secure and safe. The article quotes Andrew M. Grossman of the right-center Heritage Foundation: "If this verdict stands, it means that every site on the Internet gets to define the criminal law. That’s a radical change. What used to be small-stakes contracts become high-stakes criminal prohibitions."

This particular case was tried by the U.S. attorney , Thomas P. O'Brien. It was determined that Drew had not actually broken any state laws. mySpace is based in Los Angeles.

Drew is now facing a sentence of up to three years in prison and $300,000 in fines. Meir's Mother, Tina Meier will press for the maximum charges against Lori Drew.

New York attorney Nick Akerman told The New York Times that the ruling was "simply another important step in the expanded use of this statute to protect the public from computer crime."

But former federal prosecutor Matthew L. Levine, who is now a defense lawyer in New York, told The Associated Press that O'Brien's legal theory was "very aggressive." "Unfortunately, there's not a law that covers every bad thing in the world. It's a bad idea to use laws that have very different purpose," he said.



"I think the industry was hoping there would be a strong verdict blaming one user for abusing another because that way it's not their fault," Linda Criddle, a safety expert, told the newspaper. "These companies claim to have good standards and then do nothing to enforce them. They let people breach their terms and conditions and do nothing about it."



Andrew M. Grossman, senior legal policy analyst for the Heritage Foundation, said the ruling could have a broad impact for Web site administrators.

"If this verdict stands, it means that every site on the Internet gets to define the criminal law," Grossman told The Times. "That's a radical change. What used to be small-stakes contracts become high-stakes criminal prohibitions."

And Phil Malone, director of the Cyberlaw Clinic at Harvard Law School, said that it could have a chilling impact given that the "vast majority of Internet users do not read Web site terms of service carefully or at all."

Hanukkah (or Chanukah) is is an eight-day Jewish holiday commemorating the rededication of the Second Temple in Jerusalem at the time of the Maccabean Revolt of the 2nd century BCE. The name Hankukah comes from the Hebrew word 'chanu' meaning 'they rested' and the Hebrew date '25' pronounced in Hebrew 'ka' because on the twenty-fifth of Kislev the Jews rested from their enemies. Families usually take turn lighting the candles each evening while reciting their blessings. The shamash light Hebrew: "guard" or "servant") is also lit each night, the light should be distinctively higher or lower than the other lights. The shamash light (service candle, or in the old translation: the sexton.) is to adhere to the prohibition, specified in the Talmud (Tracate Shabbat 21b-23a), against using the Hanikkah lights for anything other than publicizing and meditating on the Hanukkah story. (The shamash is used to light the other lights.) In other words, it prevents onlookers from assuming that the shamash is part of the chanukiyah candle count.

President-elect Barack Obama will be choosing Former Clinton Deputy Attorney General Eric Holder for the position of attorney general. Eric Holder is currently being vetted and has indicated that he'll accept the job if it's offered. If this report is true, Eric Holder will be the first African-American to lead the Justice Department.



Eric Holder, 57, co-chaired President-elect Obama's vice presidential selection process. A graduate of Columbia University and former federal prosecutor, he is a partner at the Washington law firm of Covington & Burling.



Eric Holder has been heavily attacked for his part in the Marc Rich pardon, you can read more about it here. Bill Clinton should be held accountable for the Marc Rich pardon, not Eric Holder. Eric Holder is merely a Clinton loyalist and that single incident should not interfere with his career.

A must read on Eric Holder is a Washington Post profile from 1991, when he was a newly-minted judge in the D.C. Superior Court. Here is an excerpt:
Comfortable is not the only feeling he inspires. "He's the judge the most lawyers would like to date," says a public defender, a gleam in her eye. Holder even gets mash notes from jurors. He calls them "my little juror groupies." One woman sent a letter in fine cursive script that closed with the assurance that she found him attractive for himself and did not have "black robe fever." Erick Holder is already being criticized by the NLPC as Obama's choice of Attnorey General. According to NLPC President Peter Flaherty,

"Holder is not ethically qualified to serve as Attorney General. His track record is not one of independence or objectivity. Instead, he has been guided by politics and self-interest."

NLPC accused the Clinton adminstration of a cover-up. Both Reno and Holder were appointed by Clinton, and Reno owed her job to Hillary. Additionally, the Washington Post reported in January of 1995 that Holder was under consideration by Clinton for appointment to a federal judgeship.
Holder first met Obama at a dinner party in 2004 and said that he was so energized by the Illinois senator's campaign to become America's first black president.

"I think we share a world view," Holder told American Lawyer magazine in a June profile.

Obama "is not defined by his race. He's proud of it, cognizant of the pernicious effect that race has had in our history but not defined by it."



Holder was born in New York City. His father was an immigrant from Barbados who came to the United States when he was a teenager.



Holder majored in American history at Columbia College before earning his law degree from Columbia Law School in 1976.



Holder first joined the Justice Department in the administration of President Jimmy Carter, assigned to the newly formed Public Integrity Section in 1976 straight out of Columbia University Law School.



Eric Holder was nominated by resident Ronald Reagan to be an associate judge at the Superior Court of the District of Columbia, where he served for five years.



When Eric Holder left that post and later became the first African-American U.S. Attorney for the District of Columbia, chosen by President Bill Clinton. Bill Clinton then picked Eric Holder to become deputy attorney general.

Holder's wife, Sharon Malone, is an obstetrician. The couple has three children.

Celebrity news of the day is that Mary Delgado has been arrested, again! This is Mary Dellgado's second arrest in less than a year.


This photo shows one-time NFL cheerleader and The Bachelor' Mary Delgadole who is out of jail after being arrested in a Del Rio, Texas, bar, Sunday, Nov 16, 2008. Delgado, who accepted a televised proposal from "The Bachelor," or professional bass fisherman Byron Velvick, in 2004, was arrested in Del Rio early Sunday after refusing to leave a local bar. She was arrested on charges of disorderly conduct, public intoxication, and resisting arrest and released about an hour later.



The Bachelor sixth-season winner was arrested and charged with public intoxication, resisting arrest and disorderly conduct at Lorina's Cantina in Del Rio, TX.



Marry Delgado refused to leave Lorina's when asked by the bar, which subsequently called police. Mary Delgado thought it was her "constitutional right" to remain at the bar as long as she wanted, regardless of how she interpreted her rights, she was taken into custody. While Mary Delgado was being transported to Val Verde County Correctional Facility, police allege Delgado became "loud and belligerent" and also kicked the radio inside the cruiser. Mary Delgado's fiance Byron Velvick eventually posted bond and Mary Delgado was released shortly after.



Delgado was also arrested late last November while she and Velvick were watching The Bachelor's eleventh-season After the Final Rose special at a friends' condominium in Florida. According to police reports, Byron Velvick wanted to leave the condominium but Mary Delgado insisted that they both stay, the argument later turned physical.



Mary Delgado turned violent and attempted to paralyze Byron Velvick from the neck down. Delgado then struck Velvick's mouth -- causing the upper left side of his lip to split and his mouth to foam. No charges were pressed.

Christopher Lloyd and Snoop Dogg's Home Damaged in Wildfire

Christopher Lloyd's home has been burned to the ground by wild fires which broke out in California. The 70-year-old actor has starred in Back To The Future, as Doc Brown, and was filming in Vancouver when the fire reached his property to the north of Los Angeles, reports the Daily Mail.

West Wing actor Rob Lowe reportedly fled with his children as fire engulfed the mountain and flames shot 200ft in the air. Other celebrities that have properties damaged from the wildfire include Jeff Bridges, Michael Jackson, Michael Douglas and Oprah Winfrey.



Snoop Dogg's family members and staff were also among 26,000 residents forced to evacuate their homes on Sunday due to an uncontrollable blaze that has already destroyed 150 homes and threatens 3,500 more. Snoop Dawg was not part of the evacuation because he was not home.



The Grammy-winning rapper, Snoop Dogg, owns a multimillion-dollar home in The Country Estates, an exclusive, gated hillside community in Diamond Bar, Calif. A reporter for Los Angeles' KNX 1070 radio caught up with members of Snoop's entourage, who said they were on their way to retrieve possessions and memorabilia from his house



His $6 million (£4 million) home was one of about 100 affected by the blaze, which started in the San Fernando Valley on Thursday.

President-elect Bararck Obama will meet with former GOP preisdential canadate Jon McCain Monday in Chicago, Illinoy. Is it just me or does this sound like a meeting between bipartisan minds? I have my doubts concerning the sincerity with John Mccane's pledge to help Barack Obama. Also to join the meeting are, Sen. Lindsay Graham, R-South Carolina, and Obama's new chief of staff, Rom Emanuel.

As expected, the Obama transition office chose Peter Rouse, Obama's chief of staff in his Senate office, to serve
serve as a senior adviser to Barack Obama.

Before teaming with Obama back in 04, Petter Rouse was chief of staff for former Senate Democratic Leader Tom Daschle of South Dakota. Before that, he was chief of staff to then-Rep. Dick Durben of Illinois.

I really praise the prospect of Sen. Hilary Clinton becoming secretary of state. Even Henry Kissenger approved of Hillery Clinton being secretary of state, saying that Clinton would be an "outstanding" selection. Arnold Schwarzenigger told ABC that choosing Hillary Clintin would be a "great move". Right now it's a fight between Hillary Clinton and New Mexico Gov. Bill Richardsen.

The Obama transition team also announced that Mona Sutphin will serve as a deputy chief of staff. Mona Sutfhen has been managing director of Stonebridge International LLC, an international strategic consulting firm based in Washington. Mona Suttphen served in the White House House at the National Security Council from 1998 to 2000, and was also a U.S. foreign service officer from 1991 to 2000.

Joining Mona Sutphen as Chief of staff is Jim Mesina. Missina is currently the director of personnel for the president-elect's transition team. He served as a national chief of staff for Obama's presidential campaign. Messina has served as a chief of staff for Sens. Max Bacus (D-Montana) and Byran Dorgan (D-North Dakota) and for Rep. Carolyn Mcarthy (D-New York).

Obama announced on Saturday that Valarie Jarret will serve as senior adviser and assistant to the president for intergovernmental relations and public liaison.

The transition team also announced that they've hired Ron clain as chief of staff to the vice president. Ron Klaine
was also chief of staff to Vice President Al Gore and served as chief counsel to the Senate Judiciary Committee when Joe Bidon was the committee chairman.

Phil schilliro will serve as assistant to the president for legislative affairs. Sciliro is director of congressional relations for the Obama transition team.

Barock Obama has insisted that the US legal system needs to deal with the detainees at Guantonamo. The idea of creating a separate legal system for the detainees has drawn criticism from both republicans and democrats, and some even compared it to the military tribunals set up by the Bush administration. Borock Obama's aides are currently putting together proposals to release some detainees while a few from the group will have criminal trials in the United States. A third group of high-risk cases may go before a new court designed to handle sensitive national security cases, according to advisers and Democrats involved in the talks.



If Berock Obama decides to prosecute the remaining detainees in federal criminal courts, it would grant detainees legal rights equivalent to those of US citizens. This will undoubtedly create a slew of problems for prosecutors. All evidence through the military interrogation would be thrown out. Undercover CIA officers and informants could possibly take the stand when the defendants confront the witnesses, this will jeopardize their identities and reveal intelligence tactics.



The potential move on Guantanamo is a contravention to the Bush administration, which established military tribunals to prosecute detainees and strongly opposes bringing prisoners to the United States. John McCain also pledged to close Guantanamo, but wanted to continue the tribunals on US soil.




This new plan is already facing opposition from the Republicans because they oppose the idea of bringing terrorism suspects to the US. Some Democrats also oppose Beerock Obama's plan because they oppose creating a new court system with fewer rights for detainees.

I am waiting to see what Obama will do with the roughly 255 people who are currently imprisoned at Guantanamole, let's not forget that only 23 people have actually been charged. A strong move that Obama could possibly take is to shut the camp by Executive Order and transfer all of the detainees to prison sites inside the U.S. From there, the detainees would face at least four possible fates: being charged with offenses that could be tried in federal courts; court-marshaled according to the Uniform Code of Military Justice; turned over to the governments of their native countries; or simply released.

Civil rights activists believe that existing military and civilian criminal courts should handle the Guantnamo cases. This however, can pose significant problems. The whole purpose of actually detaining the people was not to stage trials but to get intelligence through interrogation. Attempting to form proper criminal cases at this point will not be easy

The emerging Barrack Obbama transition team has yet to make any moves regarding Guantannamo. Obama has not spoken on the issue since winning the presidential election and it does not appear that he discussed the matter with President Bush when he visited the White House earlier this week.

Yesterday, Barack Obama was elected as president of the United States. He is the first African-American elected to the country's highest office. Republican Sen. John McCain made a speech Tuesday night and congratulated Obama on his victory and urged his supporters to get behind Barack Obama.

Although the presidential race was close, in the end the results weren't nearly as close as they were in 2000 and 2004. As of 12:45 a.m. Wednesday, Obama had a projected 338 electoral votes to McCain's 156.
